서울의 한 모텔에서 함께 투숙한 여성을 성폭행하려고 수면제 14일 치를 먹여 사망케 한 70대 남성에게 검찰이 무기징역을 구형했다.

검찰은 16일 서울남부지법 형사합의11부(정도성 부장판사) 심리로 열린 조모(74)씨의 강간살인 등 혐의 공판에서 재판부에 무기징역을 선고해 달라고 요청했다.재범 가능성을 고려해 신상정보 고지,슈어파워볼 3분취업제한,슈어파워볼 3분전자장치 부착 명령도 함께 요청했다.

조씨는 3월 29일부터 4월 3일까지 영등포구의 한 모텔에서 피해 여성 A씨(58)에게 5차례에 걸쳐 수면제를 몰래 먹인 뒤 성폭행하려다 살해한 혐의를 받는다.객실에서 홀로 숨진 A씨는 모텔 주인이 발견해 경찰에 신고했다.

검찰 수사 결과 조씨는 A씨에게 14일 치(42정) 수면제를 먹인 것으로 확인됐다.

조씨 변호인은 이날 "강간 범행에 대한 사실관계 자체는 인정하나 살해 고의나 예견 가능성은 부인한다"는 입장을 밝혔다.

변호인은 "피고인과 피해자는 평소 함께 수면제를 복용하는 사이였다"며 "피고인은 수면제를 복용했더라도 자고 일어나면 약효가 사라지는 것으로 생각해 수차례에 걸쳐 나눠서 복용시켰다.이로 인해 사망에 이를 수 있다는 점은 알지 못했다"고 주장했다.

하지만 검찰 측은 "많은 양의 수면제를 단기간에 복용하면 사망할 수 있다는 점은 일반인들도 충분히 예견할 수 있다"며 "피고인은 피해자가 세 번째 수면제를 먹은 뒤 미동도 없이 누워 헛손질하며 횡설수설하는 등 의식이 흐려졌음에도 재차 강간할 마음으로 3일 치 수면제를 다시 음료수에 타 먹였다"고 지적했다.

이어 "이는 미필적 고의"라며 "그런데도 범행을 부인하며 반성하지 않고,슈어파워볼 3분유족과도 아무런 조치가 이뤄지지 않았다"고 말했다.

조씨는 최후 변론에서 "비겁한 짓을 하면서 저의 성적 만족을 채우려고 했다"며 "너무 잘못했다"고 머리를 숙였다.

한편 조씨는 지난 2월에도 같은 방식으로 A씨에게 수면제 7일 치(21정)를 2회에 걸쳐 먹여 성폭행한 것으로 드러났다.

변호인은 해당 혐의에 대해 "피고인의 자백 외에 보강증거가 없기 때문에 무죄를 선고해 주시기를 바란다"고 주장했다.
