가맹점에 최저가를 강요한 혐의로 재판에 넘겨진 음식 배달 애플리케이션 '요기요' 운영사인 위대한상상이 항소심에서도 무죄를 선고받았다.

12일 서울중앙지법 8-3형사부(김정곤·최해일·최진숙 부장판사)는 독점규제및공정거래에관한법률위반 혐의로 기소된 위대한상상에 대해 1심과 같이 무죄를 선고했다.

재판부는 "위대한상상이 공정거래를 고의로 해친다는 부분에 대한 검찰의 입증이 부족하다"며 "공정성 저해에 관한 일부 요건에 대해 입증이 부족하다고 해서 무죄 판단에 영향을 미치진 않는다"고 밝혔다.

위대한상상은 지난 2013년 7월부터 2016년 12월까지 요기요에 입점한 음식점에 최저가 보장제를 요구하고 이를 위반한 사업장에 일방적으로 계약 해지한 혐의를 받았다.

2020년 6월 공정거래위원회는 사측에 재발방지 명령과 과징금 4억 6800만원을 부과했고,월드컵 재방송중소벤처기업부는 위대한상상을 검찰에 고발했다.

1심 재판부는 요기요에 온라인 주문과 수수료 제도가 도입된 배경을 고려하면 최저가 보장제가 불공정거래 행위라고 판단하기 어렵다며 무죄를 선고했다.
