춘천지법 형사2부(김성래 부장판사)는 특수재물손괴 혐의로 기소된 A(45)씨에게 원심과 같은 징역 6개월을 선고하고,로또복권판매시간40시간의 가정폭력 치료프로그램 이수를 명령했다고 6일 밝혔다.

A씨는 지난 1월 원주에 있는 모친 B(63)씨의 집에서 신발장에 있던 소화기를 꺼내 TV를 내리치고 컴퓨터를 바닥에 내던져 밟거나 밥솥을 유리창에 던져 가전제품 등을 망가뜨린 혐의로 재판에 넘겨졌다.

조사 결과 그는 도박자금으로 300만원을 달라고 요구했으나 B씨가 이에 응하지 않자 홧김에 이같이 범행한 것으로 드러났다.

1심을 맡은 춘천지법 원주지원은 "누범기간 중임에도 자숙하지 않고,로또복권판매시간패륜적 범행을 저질렀다"며 실형을 선고했다.

'형이 무거워 부당하다'는 A씨 측 주장을 살핀 항소심 재판부는 "피고인의 부친이 당심에서도 피고인의 선처를 바란다는 취지의 탄원서를 제출했으나 이는 원심이 피고인에 대한 형을 정하면서 충분히 고려한 사정에 해당한다"며 "원심의 양형 판단을 그대로 유지하는 것이 부당하다고 인정될 만한 새로운 정상이나 사정변경도 없다"며 이를 받아들이지 않았다.
