직권남용·선거법 위반 혐의
대법원이 더불어민주당 이재명 대선 후보의 공직선거법 위반 사건을 유죄 취지로 파기환송한 것과 관련해 시민단체가 7일 조희대 대법원장을 고위공직자범죄수사처(공수처)에 고발했다.
사세행은 이 후보 사건이 대법원 2부에 배당되자마자 소부 심리도 없이 조 대법원장이 2시간 만에 대법원 전원합의체에 사건을 회부하는 등 법원조직법을 어겼다고 주장했다.사세행은 또 “지난달 24일 전원합의체 회부부터 1일 선고까지 단 9일 만에 6만8000쪽에 달하는 사건 기록을 충분히 검토해 결론에 도달할 수 있는지에 대한 국민적 의혹이 크다”며 “조 대법원장을 포함해 대법관들의 이 후보 사건 심리가 부실해 충분한 기록 검토조차 없이 무리하게 강행된 졸속 판결이라는 비판이 일고 있다”고 주장했다.
이들은 아울러 이 후보 피선거권 박탈을 시도해 공무원 선거 관여를 금지한 선거법 85조 1항을 어겼고,맞추기 게임 사이트상고심 생중계로 이 후보에 관한 허위사실을 공표했다며 낙선 목적 허위사실 공표를 금한 선거법 250조 2항을 위반했다고도 주장했다.
