[헤럴드경제=정석준 기자] 고객 개인정보를 중국의 알리페이에 넘긴 카카오페이에 개인정보보호위원회가 부과한 시정명령의 효력을 법원이 멈췄다.

2일 법조계에 따르면 서울행정법원 행정12부(강재원 부장판사)는 지난달 30일 카카오페이가 개인정보위를 상대로 낸 집행정지 신청을 인용했다.

재판부는 개인정보 국외 이전에 대한 적법성을 갖추도록 한 시정명령과 홈페이지및 애플리케이션에 관련 사실을 게시하도록 한 공표명령의 효력을 멈추도록 했다.

재판부는 “각 처분으로 인해 신청인에게 발생할 회복하기 어려운 손해를 예방하기 위해 긴급한 필요가 있다고 인정된다”며 “효력정지로 인해 공공복리에 중대한 영향을 미칠 우려가 있는 때에 해당하지 않는다”고 이유를 밝혔다.

다만 개인정보위가 부과한 과징금은 집행정지 대상에 포함되지 않는다.

개인정보위는 카카오페이가 약 4000만명인 전체 이용자 개인정보를 동의 없이 애플의 서비스 이용자 평가를 위해 알리페이에 제공했다며 지난 1월 59억6800만원의 과징금을 부과하고 시정명령을 내렸다.

카카오페이 측은 알리페이는 애플의 결제처리와 관련한 수탁사라고 주장했다.
