법원은 A 씨가 제품에 사용한 바둑판 문양,별 문양이 대중적으로 인지도가 높은 문양이라고 보기 어렵고,온라인 판매의 생존A 씨 본인도 해당 문양들이 루이뷔통 상표인지 몰랐다고 지적했습니다.

그러면서 A 씨가 판매한 제품의 문양들이 루이뷔통 제품의 문양과 다소 차이가 있고,가격도 지나치게 싸 상표권을 해치려는 의도가 있다고 보기 어렵다고 무죄 이유를 설명했습니다.

A 씨는 지난 2023년 자신이 운영하는 잡화 루이뷔통의 등록상표와 같은 제품 21개를 판매한 혐의로 재판에 넘겨졌습니다.
