대법원이 이재명 민주당 후보의 재판을 파기환송하기까지 걸린 시간은 딱 36일인데,블랙 잭 인슈 런스이에 대한 논란이 이어지고 있습니다.

조희대 대법원장 취임 이후 평균 상고심 처리 기간은 오히려 늘었는데,5분게임유독 이 후보 재판만 이례적인 속도로 밀어붙이며 결론을 뒤집었다는 겁니다.

조희대 대법원장은 취임하면서 재판 지연 문제를 해결하겠다고 했습니다.

이번 이재명 더불어민주당 대선 후보 선고 때도 "적시 처리를 도모했다"는 게 대법원 설명입니다.

1심은 재판에 넘어온 날부터 6개월,2심과 3심은 앞선 재판 선고 뒤 각각 3개월 안에 선고하도록 돼 있는 공직선거법의 이른바 '6.3.3 원칙'을 따랐다는 겁니다.

조희대 대법원장이 취임한 이듬해인 지난해 공직선거법 사건 판결이 나오는 데는 대법원에서 평균 92일 정도 걸렸습니다.

그 직전 해인 2023년은 평균 73일 정도 걸렸습니다.

취임 이후 더 오래 걸린 셈입니다.

그런데 이재명 후보 사건은 2심 선고 이후 36일 만에 초고속으로 이뤄진 겁니다.

다수 의견을 낸 10명의 대법관 중 5명은 "철저히 중립적이면서도 신속한 절차 진행이 필요하다는 공감대가 대다수 대법관 사이 형성됐다"고 했습니다.

반면 반대의견을 낸 2명은 "전원합의체의 요체는 설득과 숙고"라면서 "재판의 신속은 절대적 가치가 아니"라고 반박했습니다.

사법부가 선거에 개입했다는 논란을 자초했다는 비판 속에서도 고등법원의 파기환송심 첫 재판이 오는 15일로 바로 잡히면서 재판 속도전은 계속될 것으로 보입니다.
