국가공무원 채용 과정에서 과거 성범죄 전과를 이유로 합격을 취소한 처분이 타당하다는 법원의 판단이 나왔습니다.

서울행정법원 행정7부는 A씨가 외교부를 상대로 낸 '자격상실 및 미임용 처분 취소' 소송 1심에서 지난 2월 27일 원고 패소로 판결했습니다.

A씨는 외교부 일반행정 채용시험에서 최종 합격 뒤 채용후보자로 등록됐으나 이후 성범죄 전과 두 건이 확인되며 합격이 취소됐습니다.

A씨가 불복했으나 법원은 "불특정인에 대한 성범죄 전력이 있는 원고가 대민업무가 포함된 직무를 수행하기 곤란하다고 판단할 여지가 충분하다"며 채용취소 처분은 적법하다고 판단했습니다.

재판부는 또 "이 사건 처분으로 달성하고자 하는 공직에 대한 사회적 신뢰 제고라는 공익이 이 사건 처분으로 인해 원고가 입게 될 불이익보다 크다"고 덧붙였습니다.

A씨는 1심 판결에 불복해 항소했습니다.
