경기도,미스터 포커수사 의뢰…경찰 "항공안전법 위반 법리검토"

24일 경찰에 따르면 도는 지난 21일 경기북부경찰청과 파주경찰서에 항공안전법 위반 혐의로 탈북민단체 자유북한운동연합에 대한 수사를 의뢰했다.

경찰은 이 사안을 파주경찰서에 배당했고 현재 법리검토를 진행 중이다.

경찰 관계자는 "아직 본격적인 수사가 시작된 것은 아니고 대북 전단 살포 금지가 헌법재판소에서 위헌 결정을 받은 상황에서 경기도가 다른 혐의를 적용해 수사 의뢰해 우선 법리 검토를 하고 있다"고 밝혔다.

앞서 도는 수사의뢰 공문에 '대북전단에 사용되는 대형 풍선은 항공안전법에 따른 초경량비행장치에 해당돼 국토교통부 장관의 비행 승인 없이 사용할 수 없는 장치로 판단된다'며 '대북전단 풍선에 2㎏ 이상의 물건을 매달아 비행하는 경우 초경량비행장치로 간주해 처벌할 수 있다'고 명시했다.

도는 자유북한운동연합이 지난 20일 오후 10시10분께 파주시 월롱면의 남북중앙교회 건물 뒤편에서 대북전단을 풍선 9∼10개에 매달아 북으로 날려 보내는 영상 자료를 확인했다고 밝혔다.

자유북한운동연합도 이날 배포한 보도자료에서 대북전단 30만장과 이동식저장장치(USB),1달러 지폐 등을 담은 대형 풍선을 북으로 띄웠다고 했다.

경기도는 북한의 오물풍선 살포,미스터 포커민간단체의 대북전단 살포,정부의 대북 확성기 재개 등으로 한반도 긴장이 높아지자 대북전단 살포 예상 지역에 특별사법경찰관들을 출동시켜 순찰활동을 벌이고 있다.
