A군은 2022년 11월 경남 창원의 한 고등학교 교실에서 다른 학생들과 얘기 중이던 기간제 교사 B씨(20대·여)에게 “임용도 안 된게 여기 있냐,2014 브라질 월드컵 콜롬비아됐으면 여기 없었겠지” 등의 조롱성 발언을 했다.같은해 12월까지 비슷한 취지의 말로 3회에 걸쳐 B씨의 명예를 훼손한 혐의로 기소됐다.

또 2022년 9월에는 수학여행으로 떠난 합천의 한 물놀이장에서 B씨의 어깨를 강하게 눌러 물 밖으로 나오지 못하게 하는 방법으로 폭행하기도 했다.그해 12월 교실에서 B씨를 넘어뜨려 뇌진탕 등의 상해를 가한 혐의도 받았다.

김 부장판사는 “기간제 교사인 피해자를 장난을 빙자해 폭행하거나 상해를 가하는 등 죄질이 가볍지 아니하고,2014 브라질 월드컵 콜롬비아피해자와 합의도 안했다”며 “자백하고 반성하는 태도를 보이는 점,형사처벌 받은 전력이 없는 점 등을 종합해 형을 정했다”고 양형 이유를 밝혔다.
