15일 서울경찰청에 따르면 보건복지부는 지난 12일 영상을 게시한 20대 여성 A 씨와 수술 담당 의사를 살인 혐의로 경찰에 수사 의뢰했다.

A 씨는 지난달 27일 유튜브에 '총 수술비용 900만원,수로 시작하는 단어지옥 같던 120시간'이라는 제목의 영상을 올리며 자신이 임신 36주차에 낙태 수술을 받았다고 주장했다.A 씨는 여러 병원에서 낙태 수술을 거절당하다 한 병원에서 절개수술을 받았다고 했다.

이를 두고 온라인에서 '태아 살인'이라는 지적이 나왔다.A 씨의 낙태 주장이 조작일 수 있다는 의혹도 제기됐다.

임신 24주를 넘어가는 낙태는 모자보건법상 불법이지만 2019년 헌법재판소가 낙태죄 헌법불합치 결정을 내리고 대체입법이 5년째 지연되면서 처벌 효력이 없는 상황이다.이에 복지부는 모자보건법 위반 대신 살인 혐의로 수사를 의뢰했다.

경찰 관계자는 "다른 일반적인 낙태 사건과는 다르게 무게 있게 수사를 할 생각"이라며 "36주 정도면 일반적으로 (태아가) 자궁 밖으로 나와서 독립적 생존이 가능한 정도"라고 말했다.

이어 "고발장의 내용만으로는 사실이 확인됐다고 얘기하기는 사실 성급한 것 같다"면서도 "일단 유튜브를 보면 낙태한 건 사실로 보이고 사실을 전제로 수사를 출발해야 한다.종합적 사실 확인을 거쳐서 적용 죄명을 의율할 생각"이라고 덧붙였다.
