공정위는 의협이 집단 휴진과 총궐기 대회를 주도하면서 구성 사업자의 진료활동을 부당하게 제한하는‘사업자단체 금지 행위’를 했다고 보고 있다.

사업자단체 금지행위는 사업자단체가 일정한 거래 분야에서 현재 또는 장래의 사업자 수를 제한하거나 구성 사업자의 활동을 부당하게 제한하는 행위 등에 인정된다.

법 위반 여부를 판가름하는 핵심은‘강제성’이다.의협이 구성원들에게 직·간접적으로 휴진 참여를 강제했다고 판단돼야만 공정거래법 위반으로 처벌이 가능하다.

앞서 보건복지부로부터 의협에 대한 신고를 접수해 검토한 공정위는 의협이 구성원들에게 문자 메시지와 공문,보루시아 도르트문트 순위SNS 게시물 등을 통해 직·간접적으로 휴진 참여를 강제한 정황이 있다고 판단한 것으로 전해졌다.
