앞서 소송을 낸 의사들은 다른 의사 A 씨와 함께 의료기관을 개설해 운영해왔습니다.

그런데 A 씨가 국민건강보험공단으로부터 부담금을 거짓으로 타내 벌금형을 확정받았고,산리오 어묵칩이에 정부는 2018년 8월부터 10월까지 A 씨 의사면허 자격을 정지했습니다.

이후 A 씨를 공동원장에서 탈퇴시킨 원고들은 자격정지 기간 발생한 요양급여와 의료급여 6억 원가량을 평가원에 청구했습니다.

그런데 평가원이 '급여를 청구할 자격이 없다'며 청구를 받아들이지 않자,산리오 어묵칩소송에 돌입해 1심과 2심에서 이겼습니다.
