'불공정거래 조사‧심리기관 협의회' 첫 회의

금융위원회·검찰·금융감독원·한국거래소는 24일 오후 정부서울청사에서 제1차 '불공정거래 조사·심리기관 협의회'(이하 '조심협')을 열고 이 같은 업무 방침을 논의했다.

작년 자본시장법 개정으로 미공개 중요정보 이용행위,시세조종 행위,부정거래 행위 등에대해 과징금 부과가 가능해졌다.조심협은 올해 금융위원회의 자본시장 조사인력이 3명 증원되는 만큼,늘어난 인력을 통해 과징금 부과,블린트 등번호부당이득 산정,자진신고 감면 등에 적극적으로 나서도록 할 방침이다.

이를 위해 금융위와 검찰은 각 기관을 대표하는 협력관을 지정해 소통을 강화하고,과징금 우선 부과를 위한 협의에 적극 나서기로 했다.금융위는 원칙적으로 검찰로부터 불공정거래 혐의자에 대한 수사·처분 결과를 통보받은 후 과징금을 부과한다.그럼에도 검찰 통보 후 검찰과 협의하거나 검찰통보 후 1년 경과 시에는 수사·처분 결과 통보 이전이라도 과징금 부과가 가능하다.

또 조심협은 불공정거래 대응 체계의 특성 상 조사가 적시에 이뤄져야 하기에 적시에 불공정거래를 적발하고 제재하기 위한 조사 효율화 방안도 논의했다.현재 불공정거래 조사는 '혐의포착 및 심리(거래소) → 조사(금융위·금감원) → 행정제재 또는 고발·통보(금융위/증선위) → 수사(검찰) → 형사처벌(법원)' 등의 여러 단계로 인해 적시 적발과 제재의 한계가 있다.
