술에 취한 지인을 업고 내려주던 중 뒤로 넘어져 숨지게 한 혐의로 재판에 넘겨진 20대가 금고형의 집행유예를 선고받았다.

6일 법조계에 따르면 서울서부지법 형사7단독은 과실치사 혐의로 기소된 20대 A(27) 씨에게 금고 6개월에 집행유예 1년을 선고했다.

A씨는 지난해 6월 오전 5시쯤 피해자 B(28) 씨 등 3명과 서울 용산구 일대에서 술을 마신 뒤 오전 10시쯤 택시를 타고 강남구에 있는 한 일행의 집으로 이동했다.

당시 B씨는 만취했고 A씨는 택시에서 내린 후 B씨를 업고 일행의 집에 도착했다.

이후 거실 바닥에 B씨를 내려놓다 뒤로 넘어졌고,하포하포 케이스뒷머리를 거실 바닥에 부딪힌 B씨는 폐쇄성 두개골 골절,하포하포 케이스외상성 경막하출혈 등으로 중환자실에서 치료받다 8일 만에 숨졌다.

재판부는 "피고인이 무릎을 꿇은 상태에서 (업혀 있는) 피해자의 손을 놓을 때 피해자의 머리가 거실 바닥에서 약 1m 높이에 있었고 크게 쿵 소리가 날 정도로 피해자의 머리가 바닥에 부딪힌 점 등을 종합해 볼 때 피고인의 과실을 인정할 수 있다"고 지적했다.

다만 "A씨가 B씨를 내려놓을 때 같이 있던 동료 2명이 도와줄 것이라 기대했던 점,하포하포 케이스또 B씨의 유족이 처벌을 원하지 않는 점 등을 고려했다"고 양형 이유를 밝혔다.
