비전업 시간강사의 연차휴가·주휴수당 지급 여부를 결정할 때 소정근로시간에 강의 시간뿐만 아니라 강의 준비와 학사행정 업무 등을 하는 시간도 포함해야 한다는 대법원 판단이 나왔다.

12일 법조계에 따르면 대법원 1부(주심 김선수 대법관)는 전날 국립대 비전업 시간강사 A씨 등이 국가를 상대로 낸 임금 소송에서 원고 일부 승소한 원심 판결을 파기하고 사건을 서울고법으로 돌려보냈다.A씨 등은 2020년 대학을 상대로 전업과 비전업을 구분해 차등 지급한 강의료와 3년간 미사용 연차휴가·주휴수당에 대한 지연손해금을 달라고 소송을 냈다.

1심은 비전업 시간강사 측 손을 들어줬다.그러나 2심은 연차휴가·주휴수당 청구를 기각했다.대법원 판단은 달랐다.위촉계약이 정한 업무 외에 '강의 수반 업무'가 많다는 취지다.
