방송인 박수홍 씨가 검찰청에서 들것에 실려 나옵니다.

형이 자신의 출연료를 횡령한 사건을 두고 조사를 받으려다 아버지에게 폭행을 당한 겁니다.

박씨 아버지는 재산을 가로챈 건 형이 아니라 자신이라고 주장했습니다.

'친족상도례'를 의식한 것 아니냔 지적이 나왔습니다.

이 법에 따르면 부모나 자식,로또 당첨 번호 순서배우자,로또 당첨 번호 순서같이 사는 친족이나 가족 사이에 일어난 재산범죄에 대해서 죄를 물을 수 없습니다.

따로 사는 형제 등 그 외 친족만 처벌할 수 있습니다.

그런데 오늘 헌법재판소가 재판관 전원일치로 헌법불합치 결정을 내렸습니다.

친족 범위가 워낙 넓은 데다 중대한 재산 범죄의 경우 사안을 달리 봐야한다는 겁니다.

지적장애인이나 미성년자의 경우 다른 가족에게 경제적인 착취를 당할 우려도 있다고 지적했습니다.

이 법은 가까운 친족끼리 재산을 공동관리하는 경우가 많아 가족 내부의 결정을 존중해야 한다며 1953년 도입됐습니다.

오늘 판단에 따라 이 조항의 적용은 중지되고 내년 말까지 국회가 법을 바꾸지 않으면 효력을 잃습니다.
