술을 마신 채 경찰관의 음주 측정 요구를 거부해 재판에 넘겨진 50대 남성이 벌금형을 선고받았다.

법조계에 따르면 부산지법 형사10단독(허성민 판사)은 도로교통법 위반(음주측정거부) 혐의로 기소된 A씨에게 벌금 700만원을 선고했다고 6일 밝혔다.

A씨는 2024년 11월 2일 오전 6시께 술에 취한 상태로 부산 해운대구 한 노래방에서 동래구까지 승용차를 운전하고 경찰관의 음주 측정 요구를 거부한 혐의를 받는다.

신고받고 출동했던 경찰관은 당시 A씨가 혀가 꼬여 발음이 부정확하고 걸음걸이가 비틀거리는 등 음주운전을 했다고 인정할 만한 사유가 있어 21분간 3차례에 걸쳐 음주 측정을 요구했다.

그러나 A씨는 '음주 측정할 생각 없고,토토 커뮤니티 더블유놀이터집에 갈 거니까 알아서 해라'는 말을 하며 음주 측정 요구를 거부했다.

허 판사는 "음주 측정 거부 범죄는 사회적 위험성이 큰 음주운전의 증명과 처벌을 어렵게 하고 공권력을 경시하는 풍조를 조장하는 범죄로서 엄히 처벌할 필요가 있다"고 판결했다.
