대법원 양형위원회가 동물을 죽이거나 다치게 하는 범죄를 처벌할 때 판사들이 참조할 양형 기준을 신설하기로 했습니다.

양형위는 어제(17일) 오후 132차 전체 회의를 열고 동물보호법 위반 범죄에 대한 양형기준 설정 안에 합의했다고 오늘 밝혔습니다.

신설 양형기준은 크게 두 가지 유형으로,동물을 '죽이거나 죽음에 이르게 하는 행위',무료 프로야구'고통을 주거나 상해를 입히는 행위'로 나누어 형량을 권고합니다.

동물보호법은 각 범죄의 법정형을 최대 징역 3년과 징역 2년으로 정하고 있습니다.

양형위는 "동물복지에 대한 사회적 관심이 높아지면서 동물의 생명권 등에 대한 국민의 관심이 높아졌다"며 "국민적 관심과 발생 사건수의 증가,각계의 양형기준 신설 요청 등을 종합해 양형기준을 신설하기로 했다"고 밝혔습니다.

실제로 동물보호법 위반 범죄가 경찰에 신고된 건수는 2010년에 69건이었으나 2021년에 1천72건,무료 프로야구2022년에 1천237건으로 크게 늘었습니다.

반려동물을 키우는 인구가 크게 늘고 사회적 인식도 달라졌지만 법원에서 선고되는 형량은 가벼운 편이어서 '솜방망이 처벌'이라는 지적이 그간 제기됐습니다.

양형 기준은 일선 판사들이 형량을 정할 때 참조하는 일종의 지침인데,반드시 따라야 하는 것은 아니지만 기준을 벗어나 판결하려면 별도 이유를 적어야 합니다.

판사가 재량만으로 지나치게 가볍거나 무겁게 처벌하는 것을 억제하는 역할을 합니다.

양형위는 지하철·공연장 등 공중밀집장소에서의 추행과 직장 등에서 발생하는 피보호·피감독자 대상 성범죄의 양형기준도 마련하기로 했습니다.

구체적인 권고형량 범위와 가중·감경 요소는 이번 회의에서 다뤄지지 않았습니다.

동물보호법 위반죄는 올해 11월,무료 프로야구성범죄는 내년 1월 구체적 기준을 마련하며 내년 3월 확정됩니다.
