헌법재판소가 오늘(27일) 친족 간 재산범죄는 형을 면해주는 이른바 '친족상도례'에 대한 위헌 여부를 결정합니다.

헌법재판소는 오늘 오후 2시,낮은도형법 제328조에 대한 헌법소원 4건을 묶어 선고합니다.

해당 조항은 어머니·아버지와 같은 직계혈족이나 배우자 등 가까운 친족의 재산 범죄는 처벌을 면제하도록 규정하고 있습니다.

또 그 밖의 친족에 대해선 고소가 있어야만 기소할 수 있다는 친고죄 조항에 대해서도 위헌 여부를 판단할 예정입니다.

헌재는 지난 2012년 친족상도례 조항에 대해 합헌 결정을 내린 바 있습니다.
