1심 "가르치던 학생 여러 번 추행" 징역 2년에 집유…강사 '항소'

원주시의 한 학원에서 수강생인 여학생을 뒤에서 껴안는가 하면 문제를 가르쳐주다가 엉덩이를 때리는 등 강제 추행한 50대 학원강사가 집행유예를 선고받았다.

2일 법조계에 따르면 춘천지법 원주지원 형사1부(이수웅 부장판사)는 아동·청소년의 성보호에 관한 법률 위반(강제추행) 혐의로 불구속기소 된 A씨에게 징역 2년에 집행유예 3년을 선고했다.

또 40시간의 성폭력 치료가의 수강을 비롯해 아동·청소년·장애인 관련 기관에 각 5년간 취업제한을 명령했다.

주요 과목을 가르치는 학원 강사인 A씨는 지난해 1월 13일 오후 4시 30분께 원주시의 한 학원에서 수강생인 10대 B양의 손과 어깨를 주무르고 등 부위를 문질러 강제 추행한 혐의로 재판에 넘겨졌다.

같은 해 1월 17일 오후 5시 20분께는 B양이 숙제하지 않았다는 이유로 양팔로 목 부위를 감싸는 일명 헤드록을 걸고 뒤에서 껴안아 추행한 사실도 공소장에 더해졌다.

그 해 3월 20일 오후 6시께는 학원에서 교과목 문제를 가르쳐 주다가 손바닥으로 B양의 엉덩이를 한 차례 때리는가 하면,로또 757회4월 4일에는 B양의 팔을 잡아당겨 허리를 감싸는 등 모두 4차례 추행한 사실이 공소장에 적시됐다.

재판부는 "자신이 가르치던 학생을 여러 차례 추행한 것으로 죄질이 나쁘고,로또 757회이 사건으로 인해 상당한 성적 불쾌감과 정신적 충격을 받은 것으로 보인다"고 판시했다.

이어 "다만 범행 과정에서 피해자를 폭행하거나 협박하는 등의 유형력을 행사한 정황은 확인되지 않고,로또 757회성폭력 범죄 또는 벌금형을 초과하는 형사처벌을 받은 전력이 없는 점 등을 고려해 형을 정했다"고 덧붙였다.

1심 판결에 불복한 A씨는 항소장을 제출했다.
