손흥민 선수 아버지 손웅정 감독이 아동학대 혐의로 관련해 검찰 조사를 받은 가운데,클럽 월드컵 레알대법원이 지각을 이유로 학생을 때린 고등학교 교사에게 유죄를 확정했습니다.

최민영 기자가 보도합니다.

[리포트]

지각을 했다는 이유로 학생을 야구방망이로 때린 고등학교 교사에게 징역형의 집행유예가 확정됐습니다.

피해 학생의 담임교사였던 A씨는 2019년 고등학교 1학년이었던 피해 학생이 지각을 하거나 수업시간에 졸았다는 이유로 야구방망이로 엉덩이를 한 번씩 모두 6차례 때렸습니다.

또 복도에서 마주치자 어깨를 피라며 학생의 가슴을 주먹으로 2번 때리기도 했습니다.

아동학대 혐의로 재판에 넘겨진 A씨는 신체에 손상을 줄 정도의 체벌은 아니었고,클럽 월드컵 레알전후 사정에 비추어 보면 정당한 훈육이었다고 주장했습니다.

하지만 법원은 A 씨의 주장을 받아들이지 않았습니다.

법원은 설령 지각이 잦았거나 수업태도가 좋지 않았더라도 피해 학생이 학기초부터 반을 옮겨달라고 말한 적이 있었던 점 등을 고려하면 보다 세심한 지도가 필요했을 것으로 보인다고 밝혔습니다.

또 초·중등교육법이 체벌을 절대적으로 금지하고 있고,다른 훈육방법으로 학생을 지도할 수 있었다며 A씨의 행위를 유죄로 판단했습니다.

다만 A씨가 자신의 잘못된 훈육 방식의 문제점을 심각하게 인지하고 있고,클럽 월드컵 레알피해 회복을 위해 무급휴직과 전근 등을 한 점을 고려해 징역 8개월에 집행유예 1년 6개월을 선고했습니다.

A씨는 항소했지만 2심도 같은 판단이었고 대법원도 원심을 확정했습니다.
