국제형사재판소,남미 야구ICC가 25일(현지시간) 세르게이 쇼이구 전 러시아 국방장관과 발레리 게라시모프 러시아군 총참모장에 대해 전쟁범죄 혐의로 체포영장을 발부했습니다.

ICC 전심재판부는 이날 검찰이 체포영장 신청 시 제출한 증거 등 관련 자료를 검토한 결과 이들의 체포영장 발부에 대한 법적 요건이 충족된다고 판단했다고 홈페이지를 통해 밝혔습니다.

ICC는 이들이 최소 2022년 10월 10일부터 지난해 3월 9일까지 러시아군이 감행한 우크라이나 전력 인프라에 대한 미사일 공격에 책임이 있다고 볼 만한 합리적 근거가 있다고 봤습니다.

또 당시 이 같은 공격을 지시하거나 각자의 지휘하에 있는 군을 적절하게 통제하지 못함으로써 개별적 형사책임이 뒤따른다고 설명했습니다.

쇼이구 전 장관은 2012년부터 10년 넘게 국방부를 이끌면서 블라디미르 푸틴 러시아 장관의 최측근 중 하나로 꼽히던 인물입니다.

그는 지난달 국가안보회의 서기로 자리를 옮겼습니다.

전쟁 중 갑작스러운 국방장관의 전보 발표에 사실상 경질성 인사라는 해석이 나오기도 했습니다.

ICC는 앞서 지난해 3월 우크라이나 점령지에서 아동을 '불법적으로 이주시킨' 전쟁범죄 행위에 대한 책임이 있다는 이유로 푸틴 대통령에 대한 체포영장을 발부한 바 있습니다.

통상 ICC 체포영장이 발부되면 당사국은 ICC 규정과 자국 국내법상의 절차에 따라 체포·인도청구를 이행해야 하지만 러시아는 2016년 ICC에서 탈퇴했습니다.

ICC는 피고인이 참석하지 않은 궐석 재판도 없어 신병 확보나 재판 개시가 현실적으로 불가능합니다.

체포영장 발부에 볼로디미르 젤렌스키 우크라이나 대통령은 엑스(X·옛 트위터)를 통해 "군과 내각의 계급과 무관하게 러시아 범죄자들이 책임을 면할 수 없다는 것을 보여준다"고 환영했습니다.
