[앵커]

'음주 뺑소니' 사건으로 구속 수사를 받아온 가수 김호중 씨가 오늘 재판에 넘겨졌습니다.

그런데 김 씨의 음주 수치를 정확히 파악할 수 없다며 음주운전 혐의는 빠졌습니다.

검찰은 사법 방해에 대한 처벌이 절실하다고 밝혔습니다.

최민영 기자가 보도합니다.

[리포트]

음주 뺑소니 사건을 일으켜 구속 수사를 받아온 트로트 가수 김호중 씨가 사고 발생 40일 만에 재판에 넘겨졌습니다.

[김호중/가수/지난달 24일 : "죄송합니다.반성하겠습니다.죄송합니다.(매니저한테 직접 증거 인멸해달라고 부탁하신 거 맞으세요?) 죄송합니다."]

김 씨에게 적용된 혐의는 위험운전치상과 도주치상,사고후 미조치와 범인도피교사입니다.

음주운전 혐의는 빠졌습니다.

시간의 경과에 따른 혈중 알코올 농도를 유추하는 '위드마크 공식' 계산 결과.

경찰은 사고 당시 김 씨가 현행법상 음주운전 기준을 넘겼다고 판단했습니다.

하지만 검찰은 대법원 판례를 근거로 이러한 계산 결과만으로는 음주운전 혐의의 유죄 입증이 어렵다고 판단했습니다.

검찰은 "김 씨를 정점으로 운전자 바꿔치기 등 사법 방해가 있었고,이로 인해 음주 측정이 불가했다"며 "조직화된 거짓말과 음주 교통사고 후 의도적 추가 음주 등 사법 방해에 대한 처벌이 반드시 필요하다"고 강조했습니다.

김 씨는 지난달 9일 밤 서울 강남구 압구정로에서 승용차를 몰고 음주운전을 하다 교통사고를 낸 뒤 달아났고,로또 858매니저에게 대신 자수를 시킨 혐의를 받고 있습니다.

매니저 장 모 씨는 김 씨 옷을 입고 경찰서를 찾아 허위 자수를 하고 블랙박스 메모리카드를 제거한 혐의로 불구속 기소됐습니다.

또 사고 은폐에 관여한 소속사 대표 이광득 씨와 본부장 전모 씨도 증거인멸 등 혐의로 구속기소됐습니다.
