법원.[사진 출처 = 연합뉴스]동거하던 여자친구에게 다른 애인이 생겼다는 이유로 이별을 통보받자 살해한 남성에게 징역 10년이 확정됐다.

14일 법조계에 따르면 대법원 2부(주심 김상환 대법관)는 살인 혐의로 기소된 김모(39) 씨에게 징역 10년을 선고한 원심판결을 지난달 17일 확정했다.

김씨는 작년 5월 28일 경기 안산시 단원구 전 여자친구의 집에 찾아가 살해한 혐의로 기소됐다.

김씨는 2020년부터 피해자와 교제하면서 피해자의 자녀 2명과 함께 살았다.

그러나 작년 5월 피해자로부터 다른 사람과 교제하게 되었으니 관계를 정리하자는 말을 들었다.

김씨는 범행 당일까지 재회를 요구했으나 피해자가 거절하자 화가 나 범행한 것으로 조사됐다.범행 당시 옆에는 자녀들이 자고 있었다.

검찰은 징역 30년을 구형했으나 1·2심 법원은 김씨에게 징역 10년을 선고했다.

김씨만 형이 너무 무겁다며 불복했으나 대법원은 “원심이 징역 10년을 선고한 1심 판결을 유지한 것이 심히 부당하다고 할 수 없다”며 상고를 기각했다.
