21대 총선 당시 상대 후보에 대한 비방 기사를 쓴 언론사 운영자에게 현금을 준 혐의로 기소된 윤상현 국민의힘 의원의 전 특별보좌관이 2심에서도 실형을 선고받았다.

14일 법조계에 따르면 서울고법 형사6-1부(부장판사 정재오·최은정·이예슬)는 공직선거법 위반 혐의로 기소된 A씨(65)에게 징역 10개월을 선고했다.

A씨는 2020년 총선에 무소속으로 출마한 윤 의원을 당선시키기 위해 '함바브로커' 유상봉 씨와 모 단체 대표 등과 공모해 안상수 미래통합당(현 국민의힘) 후보에 대한 허위 비방 기사를 내고 선거 이후 인터넷 언론사 운영자에게 대가로 현금 900만원을 지급한 혐의로 기소됐다.

항소심 재판부는 "피고인의 행위는 선거 결과를 실질적으로 돈으로 조작하는 전형적인 부정선거 행위로 결코 용납될 수 없는 매우 중대한 범죄"라며 "피고인은 장기간 도주하는 등 민의의 왜곡 결과를 바로 잡기 위한 노력을 전혀 하지 않았다"고 밝혔다.

앞서 1심은 "피고인은 수사가 개시되자 휴대전화를 파손해 버리고 장기간 도주했고 관련자들을 수회에 걸쳐 만나 범행 후 정황이 좋지 않다"며 징역 10개월을 선고했다.
