무면허 오토바이를 운전하다 횡단보도를 건너던 보행자 2명을 치어 그 중 한명을 사망케 한 20대가 징역형을 선고 받았다.

춘천지법 원주지원 형사2단독 박현진 부장판사는 교통사고 처리 특례법 위반(치사상),도로교통법 위반(무면허운전),오브 토토병역법 위반,오브 토토폭행 등 6개 혐의로 불구속기소 된 A(22)씨에게 징역 1년 10개월의 실형을 선고하고 법정구속했다고 7일 밝혔다.

A씨는 작년 5월 19일 오후 11시 55분께 원주시청 사거리 인근에서 소형 2종 면허가 필요한 300cc 오토바이를 무면허로 몰다가 횡단보도에 뒤늦게 진입한 보행자를 미처 보지 못하고 2명을 친 혐의를 받고 있다.

이 사고로 60대 여성이 숨지고 30대 여성은 다쳐 병원 치료를 받았다.

또 A씨는 같은 해 6월 24일 오전 1시 12분께 원주의 한 앞길에서 20대 남성 B씨와 말다툼 중 머리로 B씨의 가슴을 들이받고 어깨로 밀치는가 하면,오브 토토지난 1월 16일에는 또 다른 20대 남성인 C씨의 멱살을 잡고 때리는 등 2건의 폭행 혐의도 드러났다.

지난해 6월 폭행 사건 당시 신고받고 출동한 경찰관으로부터 인적 사항을 요구받은 A씨는 벌금 수배 중인 사실을 숨기기 위해 평소 알고 지내던 사촌 형의 이름과 주민등록번호를 거짓으로 말해 주민등록법을 위반하기도 했다.

이뿐만 아니라 A씨는 2023년 11월 24일 현역 입영 통지서를 받고도 정당한 사유 없이 입영하지 않는 사실도 공소장에 포함됐다.

박 부장판사는 "무면허 운전으로 2명의 사상자를 내고 정당한 사유 없이 입영하지 않은 것은 물론 2명의 피해자를 폭행했다"며 "한 건의 폭행 사건 조사과정에서 타인의 주민등록번호를 부정 사용하는 등 공소사실 모두 인정된다"고 판시했다.

이어 "교통사고 피해자가 사망하는 등 결과가 중한 점 등을 고려하면 실형 선고가 불가피하다"며 "다만 사고 피해자들이 횡단보도에 뒤늦게 진입,적색 보행신호에 도로 한복판에 있었던 과실 등을 고려해 형을 정했다"고 덧붙였다.

A씨와 검찰 모두 1심 판결에 불복해 항소장을 제출했다.
