대구고법 제1형사부(정성욱 부장판사)는 4일 동료 재소자를 상습적으로 폭행해 숨지게 한 혐의(상해치사) 등으로 기소된 A씨(26)에 대한 항소심에서 징역 10년을 선고한 원심을 깨고 징역 7년을 선고했다.범행을 주도한 B씨에게는 원심과 같이 징역 10년을 선고했고,토토 가라머니 사이트범행에 가담한 C씨(40)에게는 원심과 같이 징역 3년을 선고했다.
재판부는 "인지능력 등이 부족한 피해자를 심하게 폭행하는 등 갖은 방법으로 괴롭히다 사망에까지 이르게 해 죄질이 극히 불량하다"며 "다만 A씨의 경우 항소심에 이르러 유족과 합의한 점을 고려해 감형했다"고 밝혔다.
피고들은 2022년 12월 경북 청송군 교도소에서 동료 재소자 D씨(56)가 행동이 어리숙하고 수형생활에 잘 적응하지 못하자 지속적으로 폭행해 숨지게 한 혐의다.
