윤 대통령의 장모 최은순 씨가 국민건강보험공단을 상대로 낸 요양급여 부당이득 환수처분 취소소송이 법원에서 각하됐습니다.

서울행정법원 행정5부(부장판사 김순열)는 오늘(27일) 오전 최 씨가 건보공단을 상대로 제기한 부당이득 환수처분 취소소송 선고기일에서 각하로 판결했습니다.

최 씨가 2022년 대법원에서 요양급여 부당이득 혐의와 관련해 무죄를 선고 받아,빌럼 축구국민건강보험공단(건보공단)에서 이미 환수를 취소했기 때문인 것으로 풀이됩니다.

행정소송법 제32조에 따라 환수처분 취소소송이 피고의 처분 취소로 각하됐을 경우 소송 비용은 모두 피고가 부담하게 됩니다.

최 씨는 지난 2013년 의료인이 아닌데도 불법으로 요양병원을 운영하고 건보공단으로부터 요양급여 약 23억 원을 받은 혐의로 2020년 11월 재판에 넘겨졌습니다.

1심에서 징역 3년의 실형이 선고되자 건보공단은 요양급여 22억 9천만 원에 대해 환수 처분을 내렸고,빌럼 축구최 씨 측은 이에 불복해 행정소송을 제기한 바 있습니다.

하지만 2022년 12월 최 씨의 혐의와 관련해 대법원 무죄 판결이 나오자 건보공단은 환수처분을 자체 취소했습니다.

이와 별개로 최 씨는 총 349억 원이 저축은행에 예치된 것처럼 잔고 증명서를 위조한 혐의로도 대법원에서 징역 1년을 확정받고 복역하다 지난 5월 가석방됐습니다.
