지난달 19일 오후 2시 26분께 광주광역시 북구 한 도로에서 한 차량이 골목을 빠져나오던 오토바이와 충돌하는 사고가 발생했다.

해당 오토바이는 주행 중 스마트폰을 보며 골목을 빠져나오는 등 전방주시에 소홀한 모습이었다.

당시 블랙박스 영상은 지난 25일 유튜브 채널 '한문철TV'(22240회)를 통해 소개됐다.

블랙박스 영상을 본 시청자들은 투표에서 '차량은 잘못 없다'에 몰표(50명 중 48표)를 던졌다.

그러나 한문철 변호사의 견해는 달랐다.한 변호사는 차량과 오토바이 사이 충분한 여유가 있었던 만큼,2024년 10월 7일 프로야구 경기경적을 울려줬다면 사고를 막을 수 있었다고 지적했다.

한 변호사는 "차와 오토바이 사이에 20m 이상 공간이 있었다.'빵'하고 경적을 울렸다면 사고를 대비할 수 있었을 것"이라며 차량의 대처가 아쉽다고 밝혔다.차량에게도 과실이 인정될 수 있다는 취지의 설명이다.

한 변호사는 만약 오토바이 운전자가 사망했을 경우 차량의 과실이 조금이라도 인정되면 유죄를 받을 수 있다고 주의를 당부했다.
