친족 간 재산 범죄 처벌을 면제하는 형법상 '친족상도례' 규정이 헌법에 어긋난다는 헌법재판소 판단이 나왔습니다.

헌재는 친족상도례를 규정한 형법 328조 1항에 대해 27일 재판관 전원일치 의견으로 헌법불합치 결정을 내렸습니다.이 조항의 적용은 중지되고 2025년 12월 31일까지 국회가 법을 개정하지 않으면 효력을 상실합니다.

헌재는 "심판 대상 조항은 형사 피해자가 법관에게 적절한 형벌권을 행사해 줄 것을 청구할 수 없도록 한다"며 "입법재량을 명백히 일탈해 현저히 불합리하거나 불공정한 것으로서 형사 피해자의 재판절차진술권을 침해한다"고 밝혔습니다.

헌재는 이날 직계혈족·배우자·동거친족·동거가족을 제외한 친족이 저지른 재산 범죄는 고소가 있어야 공소를 제기할 수 있도록 정한 328조 2항은 합헌으로 결정했습니다.
