2022년 전쟁 중인 우크라이나에 무단 입국한 혐의 등으로 재판에 넘겨진 이근(40) 전 대위가 항소심에서도 징역형의 집행유예를 받았습니다.

서울중앙지법 형사항소4-1부(양지정 엄철 이훈재 부장판사)는 오늘(18일) 여권법 위반과 특정범죄가중처벌법상 도주치상 혐의로 재판에 넘겨진 이 씨에게 징역 1년 6개월에 집행유예 3년을 선고했습니다.

1심과 같은 형입니다.

재판부는 "원심 판단은 옳고 사실오인의 잘못이 없다"며 "도주치상 혐의는 공탁은 했지만 피해자와 합의하지 못했고 여전히 납득하기 어려운 변명으로 일관하며 책임 있는 자세를 보이지 않고 있다"고 지적했습니다.

여권법 위반 혐의에 대해선 "어찌 보면 피고인이 정의감을 가지고 한 측면이 있어서 형을 더 가중하지 않겠다"며 "유명인인 피고인은 조금 더 책임 있는 자세를 보여달라"고 주문했습니다.

해군특수전전단(UDT/SEAL) 대위 출신인 이 씨는 2022년 3월 외교부의 여권 사용 허가를 받지 않고 여행경보 4단계(여행금지)가 발령된 우크라이나에 입국한 혐의로 재판에 넘겨졌습니다.

그는 우크라이나에서 외국인 부대인 '국토방위군 국제여단'에 합류한 것으로 알려졌습니다.

그는 이후 전장에서 다쳤다며 출국 두 달 뒤 치료를 위해 귀국했다가 경찰에 자진 출석했습니다.

이 씨는 그해 7월 서울 시내에서 차를 운전하다가 오토바이와 사고를 낸 뒤 구조 조치 없이 현장을 떠난 혐의도 받았습니다.

이 씨는 선고 후 취재진과 만나 "우크라이나에 가기 전 처벌을 받을 거라 인식했지만 사명감을 가지고 도와주고 싶어서 간 것이라 후회는 없다"며 "법 위반은 죄송하게 생각하며 한국인으로서 법은 지켜야 하기에 책임감 있게 살아가겠다"고 말했습니다.
