(전주=연합뉴스) 정경재 기자 = 신고받고 출동한 경찰관을 폭행한 40대가 항소심에서 감형받았다.

전주지법 제2형사부(김도형 부장판사)는 공무집행방해 혐의로 기소된 A(45)씨에 대한 항소심에서 징역 1년을 선고한 원심을 깨고 징역 10개월을 선고했다고 15일 밝혔다.

A씨는 지난해 6월 4일 오전 2시 15분께 익산시 한 아파트에서 경찰관의 가슴을 머리로 들이받은 혐의 등으로 기소됐다.

그는 이 범행에 앞서 112에 전화를 걸어 "여기 엄마 집인데 내가 다 때려 부수겠다"고 신고했다.

A씨는 경찰관들이 출동하자 가재도구 등을 집어던지면서 "경찰을 때리면 교도소에 들어갈 수 있지 않으냐"고 말한 뒤 폭행을 저질렀다.

그는 2022년에도 상해와 공무집행방해죄로 법원에서 징역 1년을 선고받고 수감된 전력이 있는 것으로 드러났다.

1심 재판부는 "피고인은 다수의 동종 전과가 있는데도 또다시 범행을 저질렀으므로 엄벌이 불가피하다"면서 실형을 선고했다.

이에 A씨는 '원심의 형이 너무 무거워서 부당하다'고 항소했다.

항소심 재판부는 "피고인의 폭행 정도가 상대적으로 경미하고 피해 경찰관을 위해 형사 공탁한 점을 참작했다"며 "피고인이 술에 취한 상태에서 우발적으로 범행했고 공소사실을 인정하며 반성하는 점 등을 고려해 형을 정했다"고 판시했다.
