윤석열 대통령의 처가가 연루된 '양평 공흥지구 특혜 의혹'과 관련한 허위공문서 작성 등 혐의로 기소된 경기 양평군청 공무원 3명에게 1심 법원이 무죄를 선고했습니다.

수원지법 여주지원 형사2단독 김수정 판사는 오늘(14일) A 씨 등 양평군 공무원 3명의 허위공문서 작성 및 행사 혐의 사건 선고 공판을 열고 이같이 판결했습니다.

재판부는 "피고인들은 사업시한 연장을 위해 허위공문서를 작성했다고 보기 어렵고,제로 카지노이에 대한 인식이나 허위공문서 행사를 위한 목적도 없었으므로 이 사건 공소사실은 범죄사실의 증명이 없는 때에 해당해 무죄"라고 밝혔습니다.

그러면서 공소사실에 담긴 실시계획 변경 과정의 검토 보고서에 빠진 시행자와 시행 기간 변경에 대해 "도시개발법상 심의 절차를 다시 거치지 않아도 되는 '경미한' 변경에 해당한다"고 선고 이유를 밝혔습니다.

A 씨 등은 윤석열 대통령의 처남 김 모(54) 씨가 실질적 소유자인 시행사 ESI&D가 2014년 11월까지 마무리했어야 할 공흥지구 도시개발사업을 끝내지 못하고 사업시한을 1년 8개월 넘겼는데도 사업시한을 임의로 연장해 준 혐의로 지난해 6월 기소됐습니다.

앞서 검찰은 이들이 사업시한 연장과 같은 도시개발사업 관련 '중대한' 변경 사항을 '경미한' 것처럼 꾸며 보고서를 작성한 것으로 보고 지난달 15일 열린 결심 공판에서 각각 징역 1년을 구형했습니다.

검찰은 A 씨 등이 사업시한 변경과 관련한 절차를 원칙대로 밟을 경우 아파트(350세대 규모) 준공이 늦어지고,제로 카지노이로 인해 입주 예정자들의 민원이 쏟아질 것을 우려해 사업 시한을 임의로 변경한 것으로 봤습니다.

한편,ESI&D가 시행한 공흥지구 도시개발사업과 관련해 사문서위조 및 행사 혐의로 지난해 7월 불구속 기소된 ESI&D 대표이사인 윤 대통령의 처남 김 모(54) 씨와 시행사 관계자 등 5명은 1심 재판을 받고 있습니다.
