[세종=뉴시스]여동준 기자 = 공정거래위원회가 하도급 공사대금을 지급하지 않은 대상건설을 제재했다.

공정위는 7일 하도급법을 위반한 대상건설에 시정명령을 부과했다고 밝혔다.

대상건설은 지난 2021년 6월 전남 목포시 상동 주상복합 신축공사 중 인테리어 공사를 위탁한 뒤 8월 목적물을 인수했음에도 목적물 인수일로부터 60일이 도과한 뒤까지 하도급 대금 4억5920만원 중 1억3920만원과 이에 대한 지연이자를 지급하지 않았다.

또 하도급 공사대금 2억원을 만기일이 목적물 인수일로부터 60일을 초과하는 어음으로 지급하면서,빙고게임 방법목적물 인수일이 60일 지난 시점부터 만기일까지 초과기간에 대한 법정 어음할인료 246만원을 지급하지 않기도 했다.

대상건설은 공사를 위탁하면서 계약체결일부터 30일 이내에 하도급법상 의무인 공사대금 지급보증도 하지 않았던 것으로 확인됐다.

공정위는 대상건설이 하도급법을 위반했다고 보고 재발방지명령과 함께 미지급 하도급 대금,빙고게임 방법지연이자 및 어음할인료 지급을 명했다.

하도급법은 목적물 수령일부터 60일 이내에 수급사업자에게 하도급대금을 지급하도록 하고 있다.이 기한을 초과해 대금을 지급할 경우 초과기간에 대해 연 15.5%의 지연이자도 지급해야 한다.

고금리·고물가 등으로 인해 건설경기가 위축된 상황에서 이번 조치는 대금 미지급 등으로 인한 수급사업자의 피해 구제와 권익향상에 기여할 것으로 기대된다.

공정위 관계자는 "앞으로도 건설시장에서의 불공정하도급거래행위에 대한 엄정한 법 집행을 통해 수급사업자의 불이익을 방지하고 공정한 하도급거래 질서가 정착되도록 노력할 계획"이라고 말했다．
