[앵커]

압구정 현대아파트에서 경비업무를 위탁계약으로 전환하며 고용승계를 조건으로 기존 경비원 약 100명을 해고한 건 정당하다는 대법원 판단이 나왔습니다.

최저임금 인상과 퇴직금 부담 증가로 비용 부담이 커진 점 등 긴박한 경영상의 필요가 있었다는 이유입니다.

김태훈 기자의 보도입니다.

[리포트]

경비원들의 고용 문제로 10년째 갈등이 계속됐던 서울 압구정 현대아파트.

[입주자 대표회의 관계자/음성변조/2014년 12월 : "관리업체와의 계약을 연장하지 않는다는 것만 결정났습니다.그것은 우리 자체 판단이니까…."]

[아파트 경비원/음성변조 : "여기서 생계를 해가지고 식구들 먹여 살리고 그랬는데 갑자기 이런식이라면 힘들죠."]

입주자대표회의는 결국 2018년 경비업무를 위탁 계약하기로 하고 경비원 약 100명에게 해고를 통보했습니다.

다만 새로운 용역업체로 고용이 승계되는 조건이었습니다.

대부분의 경비원들은 이를 받아들였지만,사샤 칼라이지치당시 경비반장이었던 A씨는 노동위원회에 구제신청을 냈고,재심 끝에 중앙노동위원회로부터 부당해고라는 판정을 받았습니다.

입주자대표회의는 중노위 결정에 불복해 소송을 제기했습니다.

1심은 경비원 측의 손을 들어줬지만 2심의 판단은 달랐습니다.

2심 재판부는 "최저임금 인상과 퇴직금 부담 증가 등을 이유로 위탁관리로 변경한 것은 합리성을 인정할 수 있다"며 '긴박한 경영상의 필요'가 있었다고 판단했습니다.

또 입주자대표회의가 경비원들에게 "100% 고용 승계를 제시했고,사샤 칼라이지치해고 50일 전부터 협의에 나서는 등 해고를 피하기 위한 노력을 다했다"고 덧붙였습니다.

중노위 측이 상고했지만 대법원의 판단도 2심과 같았습니다.

대법원 관계자는 "고용승계를 거부한 경비원을 해고했다는 점이 고려됐다"고 설명했습니다.
