층간소음 문제로 갈등을 겪던 이웃을 찾아가 실내에 침입한 후 소란을 피운 30대 여성에 법원이 무죄를 선고했다.

29일 법조계에 따르면 서울북부지법 형사12단독 허명산 판사는 층간소음으로 갈등을 겪던 이웃의 주거에 침입한 혐의로 재판에 넘겨진 이모(30) 씨에게 지난 14일 무죄를 선고했다.

판결문에 따르면 이씨는 지난 2022년 3월 27일 오후 8시쯤 서울 동대문구에 있는 한 아파트에서 이웃인 박모씨의 집 거실에 침입한 혐의로 기소됐다.

이씨는 박씨의 가사도우미가 문을 열어준 틈을 타 거실까지 뛰어 들어갔고 "내가 이 소리를 맨날 듣고 있다"며 1시간가량 소란을 피운 것으로 검찰은 판단했다.

사건 전날에도 이씨는 박씨의 현관문 앞에 주의를 당부하는 내용이 적힌 쪽지를 붙이거나 인터폰으로 조용해줄 것을 부탁한 것으로 파악됐다.

재판부는 이씨에게 주거침입 의도가 없었던 것으로 봤다.재판부는 "평소 층간소음 분쟁이 있었던 점을 고려하면 애초 박씨의 의사에 반해 소란을 피울 목적으로 박씨의 집을 찾아갔다는 점을 객관적으로 인정할 만한 사정이 인정되지 않는다"고 판단했다.

더불어 제출된 증거에 따르면 박씨의 가정부가 이씨를 만류하면서 거실까지 침입하지는 않았던 것으로 판단됐고,메이저사이트 벳 무브박씨가 현관문 앞에 서 있던 이씨를 촬영하자 이씨가 이에 항의하고자 했던 부분도 고려됐다.
