코로나19 확산 방지를 위해 도심 집회를 금지한 2020년 당시 집회를 연 변희재 미디어워치 대표 고문이 대법원으로부터 벌금형을 확정받았다.공공의 안전을 위해 긴급한 처분이 필요하거나 상당한 이유가 있는 경우에는 사전 통지 없이도 집회 금지 등의 처분을 내려도 된다는 취지다.

15일 법조계에 따르면 대법원 제1부(주심 김선수 대법관)는 감염병의 예방 및 관리에 관한 법률 위반 혐의로 재판에 넘겨진 변 대표에게 벌금 150만 원을 선고한 원심 판결을 확정했다.

대법원은 “자유심증주의의 한계를 벗어나거나 감염병의 예방 및 관리에 관한 법률 위반죄의 성립,뇌 스트레스집회 금지 통보 절차,뇌 스트레스집회의 자유,뇌 스트레스비례원칙 등에 관한 법리를 오해한 잘못이 없다”고 밝혔다.

변 대표는 2020년 2월 서울시가 코로나19 확산 방지를 위해 도심 집회를 금지했지만 미디어워치 독자 모임을 명목으로 50여 명이 참가한 집회를 열었다.이에 서울특별시장의 집회 제한·금지 조치 위반으로 기소됐다.변 대표는 서울시로부터 적법한 집회 금지 통보가 이뤄지지 않았기 때문에 집회 제한을 위반하지 않았다고 주장했지만 재판부 모두 변 대표의 유죄를 인정했다.
