서울중앙지법 민사합의14부(부장 정하정)는 조 대표 부녀가 조선일보와 소속 기자를 상대로 낸 손해배상 청구 소송에서 14일 "피고들은 공동해 조 대표에게 700만 원,맨체스터 시티 fc 대 레알 마드리드 라인업조씨에게 1,맨체스터 시티 fc 대 레알 마드리드 라인업000만 원을 배상하라"고 선고했다.

조 대표 부녀는 "2021년 6월 21일 조선일보가 성매매 위장 절도 사건 기사에 우리 모습이 담긴 삽화를 사용했다"며 10억 원을 청구하는 소송을 냈다.원래 이 삽화는 그보다 4개월 전 서민 단국대 교수가 조 대표 부녀를 비판하는 칼럼에서 쓰였다.가방을 멘 조 대표의 뒷모습,맨체스터 시티 fc 대 레알 마드리드 라인업모자를 쓴 조씨의 모습,드라마 '미스터 션샤인'에 등장하는 배우 이병헌·변요한의 모습이 담겨 있다.그런데 조선일보 측에서 실수로 형사 사건 기사에 이 삽화를 가져다 쓴 것이다.나중에 조선일보는 삽화를 삭제하고 조 대표 부녀에게 사과했다.

이 소송에서 재판부는 조선일보 측 과실을 인정했다.재판부는 "절도 범행을 보도하면서 아무런 관련도 없는 원고들이 묘사돼 있는 삽화를 허락 없이 사용해 원고들의 초상권을 침해해 위법하다"고 지적했다.다만,조 대표 부녀가 주장한 명예권 침해 주장은 물리쳤다.재판부는 "삽화에서 원고들의 모습이 식별되지만 기사의 전체적 내용 등에 비춰 보면 원고들이 주장하는 사실 적시가 됐다고 보기엔 부족하다"고 판단했다.
