공직선거법 위반…징역 1년6월 선고2022년 대통령 선거를 앞두고 이재명 전 더불어민주당 대표에게 현금을 전달했다는 등 조폭 연루설을 제기해 허위 사실을 공표한 혐의로 기소된 폭력 조직 국제마피아파 행동대원 박철민씨가 항소심에서도 실형을 선고받았다.

15일 연합뉴스에 따르면 수원고법 형사3-2부(김동규 김종기 원익선)는 전날인 14일 박씨의 공직선거법 위반 혐의 2심 선고 공판에서 항소를 기각하고 원심판결을 그대로 유지했다.앞서 1심은 박씨에게 징역 1년 6개월을 선고했다.

박씨는 2021년 이 전 대표가 성남시장으로 재임할 당시 국제마피아파 측근들에게 사업 특혜를 주는 조건 등으로 약 20억원을 받았다는 허위사실을 공표한 혐의로 재판에 넘겨졌다.장영하 변호사는 같은 해 10월 박씨의 말을 토대로 이 대표가 국제마피아 측근들에게 사업 특혜를 주는 조건으로 돈을 받았다는 얘기를 국민의힘 김용판 의원에게 전달했으며,토토네문방구김 의원은 경기도 국정감사장에서 당시 도지사였던 이 전 대표에 대한 조폭연루설을 제기했다.이 자리에서 김 의원은 장 변호사에게서 받았다는 박씨의 현금다발 사진과 자필 진술서 등을 공개했다.이후 해당 사진은 박씨의 렌터카와 사채업 홍보용 사진으로 밝혀져 논란이 일었다.이 사진은 박씨가 2018년 11월 자신의 페이스북에 사채업과 렌터카 등으로 돈을 벌었다는 취지로 게시한 사진과 동일한 것으로 확인됐다.

더불어민주당은 박씨와 장 변호사가 이재명 대표 당선을 막기 위해 허위 사실을 공표했다며 이들을 공직선거법 위반 등 혐의로 검찰에 고발했다.서울중앙지검은 장 변호사가 박씨의 말을 사실로 믿었다고 판단해 불기소 처분했지만,토토네문방구민주당은 해당 처분에 불복해 재정신청을 냈다.이후 법원이 신청을 인용해 장 변호사는 현재 서울중앙지법에서 이 사건 재판을 받고 있다.

항소심 재판부는 "원심 판단은 사실을 오인하거나 법리를 오해한 것이 없으며 양형도 합리적 범위를 벗어나지 않았다"고 항소 기각 사유를 설명했다.
