17일 법조계에 따르면,레알 소시에다드 대 알라베스 통계서울북부지법 형사14단독(박민 판사)은 최근 노인복지법 위반 혐의로 재판에 넘겨진 80대 A씨에게 벌금 100만원을 선고했다.

A씨는 지난해 5월 경기도 의정부에 있는 한 병원에서 피해자인 90대 여성 B씨가 콧줄(비위관)을 제거하려 하자 주먹으로 B씨의 이마 부위를 2회 때리는 등 폭행을 가한 혐의로 재판에 넘겨졌다.

또 A씨는 같은 날 B씨가 소변이 마렵다고 이야기하자 B씨에게 소변 통을 가리키며 "그럼 소변 한 번 받아먹어 봐,레알 소시에다드 대 알라베스 통계옛날에는 소변도 다 받아먹었어"라고 조롱하기도 했다.

법정에 선 A씨는 "환자가 콧줄을 임의로 제거하는 것을 막기 위해 이마를 눌렀을 뿐 폭행한 것이 아니다"라고 혐의를 부인했다.

하지만 현장을 목격한 간호사가 "A씨가 주먹으로 피해자의 이마 부위를 2회 때리는 장면을 목격했다"고 진술했고,레알 소시에다드 대 알라베스 통계재판부도 A씨의 주장을 받아들이지 않았다.

재판부는 "이마 부위를 가격하는 행위는 정당한 간병업무의 범위를 넘어 신체에 위법한 유형력의 행사로서 폭행에 해당한다"며 "목격자가 피고인을 모해하기 위해 불리한 허위진술을 할 아무런 이유가 없다는 점에서 신빙성이 인정돼,정서적 학대를 했음을 충분히 인정할 수 있다"고 양형 이유를 밝혔다.
