'합의 거부' 유족 "엄벌 원해"…피고인 측 "일부 유족과의 합의 참작"

(춘천=연합뉴스) 강태현 기자 = 지난해 11월 과속 주행에 신호까지 어겨 새벽기도를 마치고 귀가하던 3명을 치어 숨지게 한 80대에게 검찰이 2심에서도 금고 5년을 구형했다.

19일 춘천지법 형사 1부(심현근 부장판사) 심리로 열린 A(82)씨의 교통사고처리 특례법상 치사 혐의 사건 항소심 첫 공판이자 결심으로 진행된 이날 공판에서 검찰은 "원심의 형은 가벼워서 부당하다"며 이같이 구형했다.

검찰은 "과속 신호위반으로 무고한 피해자 3명이 사망해 돌이킬 수 없는 피해를 끼쳤고 죄질이 불량하다"며 "피해자 3명 중 1명의 유가족과 합의하지 못했을 뿐만 아니라 이들이 엄벌을 탄원하고 있다"고 했다.

합의에 이르지 못한 피해자 유족은 법정에서 "합의 의사가 전혀 없으며 피고인을 엄벌해달라"고 요청했다.

A씨 측 변호인은 "이 사건을 계기로 피고인이 고령 운전에 대한 경각심은 물론 다시는 운전대를 잡지 않을 것을 다짐하고 있어 재범 우려가 없고,보여줘 영어로피해자 2명의 유족과 합의한 점을 참작해달라"고 했다.

A씨 역시 "고인들과 그 유족들에게 진심으로 사과한다"며 "남은 피해자 유족들과 합의를 위해 노력하겠다"고 말했다.

A씨는 지난해 11월 22일 오전 6시 45분께 춘천시 퇴계동 남춘천역 인근 도로에서 링컨 승용차를 몰던 중 횡단보도를 건너던 보행자 3명을 들이받아 숨지게 한 혐의로 재판에 넘겨졌다.

조사 결과 A씨는 차량 신호가 적색임에도 불구하고 이를 무시한 채 그대로 달려 신호를 위반했다.

또 제한속도 시속 60㎞ 도로에서 시속 97㎞로 달린 것으로 파악됐다.

1심 법원은 피고인이 초범이고 피해자 3명 중 2명의 유족과 합의한 사정,보여줘 영어로자동차 종합보험에 가입한 점,보여줘 영어로고령이고 건강이 좋지 못한 점 등 유리한 사정과 과실 정도가 중하고 피해자 1명의 유가족이 아직 엄벌을 탄원하는 점 등을 종합해 금고 1년 6개월을 선고했다.

검찰과 A씨는 모두 양형부당을 이유로 항소했다.

항소심 선고 공판은 오는 8월 23일 열린다.
