(울산=뉴스1) 조민주 기자 = 자녀 중 한 명이라도 반대하면 부모의 묘를 이장할 수 없다는 법원의 판단이 나왔다.

울산지법 민사22부(부장판사 심현욱)는 A씨가 다른 형제들을 상대로 제기한 이장금지 가처분 신청을 받아들였다고 3일 밝혔다.

A씨는 지난 5월 형과 누나,알파메일 월드컵울주군 소재 공원묘원 측으로부터 해당 공원묘원에 있는 A씨 부모 묘 2기를 이장한 후 화장할 예정이라는 통보를 받았다.

A씨는 '부모가 화장이 아닌 매장을 원한다'는 유지를 남겼다며 법원에 묘 이장중단 가처분을 신청했다.

재판부는 망인의 공동상속인으로서 자녀들이 서로 협의해 묘 관리 여부를 결정하는 것이 원칙이라고 판단했다.

재판부는 "일단 분묘를 이장 후 화장하면 원상복구가 불가능하기 때문에 가처분을 통해 이장 행위를 일단 막을 필요성이 크다"고 밝혔다.
