세무서 직원에게 청탁한 세무사도 징역형

(남양주=연합뉴스) 김도윤 기자 = 뇌물을 받고 양도세를 깎아준 혐의로 재판에 넘겨진 세무 공무원 2명이 징역형과 벌금형을 함께 선고받았다.

의정부지법 남양주지원 형사1부(안복열 부장판사)는 4일 수뢰후부정처사 등의 혐의로 기소된 피고인 김모(47)씨에게 징역 1년 6월과 벌금 2천만원,성공스포츠추징금 1천60만원을 선고했다.

또 같은 혐의인 피고인 이모(46)씨에게 징역 1년에 집행유예 2년,성공스포츠벌금 1천만원과 추징금 561만원을 선고하고 사회봉사 80시간을 명령했다.

세무서 직원인 김씨와 이씨는 평소 알고 지내던 세무사 박모(48)씨의 청탁에 A씨의 양도소득세 약 2억원을 감면해 주고 대가로 각각 1천60만원과 5610만원을 챙긴 혐의로 기소됐다.

재판부는 "피고인들이 공소사실을 인정하고 있으나 뇌물을 받고 특정 납세자의 세금을 감면해 줘 죄질이 좋지 않다"며 "세무조사를 담당하는 공무원으로서 직무수행의 공정성과 이에 대한 사회적 신뢰를 훼손했다"고 양형 이유를 설명했다.

재판부는 이들 세무서 직원에게 청탁해 변호사법 위반 등의 혐의로 기소된 피고인 박씨에게 "범행 경위,성공스포츠내용 등에 비춰 죄질이 불량하다"며 징역 1년과 추징금 1천139만원을 선고했다.

제3자뇌물교부 혐의로 기소된 A씨에 대해서는 "뇌물을 용인했다고 볼 만한 증거가 없다"며 무죄로 판단했다.

김씨와 박씨는 구속된 뒤 보석으로 풀려나 재판을 받았으나 이날 실형이 선고돼 다시 구속됐다.
