1심 징역 15년 선고…검찰,한전 고객센터"형 가볍다" 항소

[대전=뉴시스]김도현 기자 = 돈 문제로 다툼이 생기자 야구방망이로 채무자를 때려 숨지게 한 혐의로 1심에서 중형을 선고받은 30대 전직 프로야구 선수가 항소심에서 살해의 고의가 없었다고 주장했다.

대전고법 형사1부(부장판사 박진환)는 19일 오전 10시30분 316호 법정에서 살인 혐의로 기소된 A(36)씨에 대한 항소심 첫 공판을 심리했다.

검찰은 A씨가 피해자에게 채무를 독촉하던 중 나무 야구방망이로 수차례 가격해 피해자를 살해해 1심에서 선고된 형량이 너무 가벼워 부당하다고 항소 이유를 설명했다.

A씨 측 변호인은 원심에서 범행을 자백했으며 상해 고의가 있을 뿐 살해의 고의는 없었다며 양형부당을 주장했다.특히 피해자 유족과 합의를 위해 돈을 마련 중이며 합의를 위한 시간을 달라고 재판부에 요청했다.

재판부는 이를 받아들여 한 기일을 속행하고 다음달 17일 오후 3시20분 재판을 이어갈 방침이다.

앞서 A씨는 지난 1월2일 오후 10시께 충남 홍성군 광천읍 40대 B씨가 운영하던 주점에서 같이 술을 마시던 중 돈 문제로 다툼이 생기자 야구방망이를 휘둘러 살해한 혐의를 받고 있다.

당시 A씨와 B씨는 서로 친한 사이였으며 B씨가 약 2억원을 빌리고 갚지 않자 술을 마시던 중 다툼이 발생한 것으로 파악됐다.

A씨는 현행범으로 체포됐고 재판 과정에서 사실 관계는 인정했지만 살인의 고의성이 없었다고 주장했다.

검찰은 징역 20년을 구형했으나 대전지법 홍성지청은 A씨에게 징역 15년을 선고했다.
