식별 어려운 '검은 옷'…1·2심 모두 무죄한밤중 주취자와 충돌한 교통사고에서 법원이 과거와 달리 운전자에게 '무죄'를 선고하는 경향이 나타나고 있다.

지난 9일 유튜브 채널 '한문철TV'에 올라온 '한밤중 검은 옷을 입고 1차로를 걸어오는 사람과 정면충돌' 영상에서는 만취 상태로 도로를 가로지르던 보행자와 충돌한 운전자(블랙박스 제보자)의 사연이 소개됐다.

제보자는 밤 11시께 시속 50㎞ 이상으로 도로를 달리던 중,야구 레포츠검은색 외투 차림으로 1차로를 걷던 한 취객과 부딪혔다.한밤중 검은 옷차림 탓에 보행자(취객) 식별이 어려운 상황이었다.보행자는 사고 이후 결국 사망했다.

한문철 변호사는 블랙박스 영상을 시청한 뒤 제보자가 사고를 피하기 어려웠을 것이라고 평가했다.

그러면서 "예전 같았으면 이런 사고는 무죄 판결이 나기 어려웠다.그러나 요즘은 검은 옷으로 판별이 어려운 점 등을 감안해 유사한 사고에서 무죄 판결이 속속 나오고 있다"며 제보자가 1심과 2심에서 모두 무죄 판결을 받아냈다고 전했다.검찰은 1심에 불복해 항소를 제기했지만 기각됐다.
