울산 한 아파트 화단에서 두 번에 걸쳐 7천500만원에 달하는 현금이 발견돼 경찰이 주인 찾기에 나섰지만 일주일째 주인이 나타나지 않는 가운데,웨스턴 유나이티드 fc주인이 확인되지 않을 경우 돈이 어떻게 처리되는지에 대한 관심이 쏠리고 있다.

10일 경찰에 따르면 돈 주인이 끝까지 확인되지 않을 경우 해당 돈다발은 민법과 유실물법의 적용을 받게 될 전망이다.

민법 제253조에서는 "유실물은 법률에 정한 바에 따라 공고한 후 6개월 내에 소유자가 권리를 주장하지 않으면 습득자가 소유권을 취득한다"고 규정한다.

돈 주인이 확인되지 않고,웨스턴 유나이티드 fc경찰이 범죄 관련성이 없다고 판단하면 유실물로 취급돼 습득자에게 소유권이 돌아가게 된다는 것이다.

이번 사건에서 해당 돈다발은 아파트 경비원과 환경미화원이 각각 5천만원과 2천500만원을 발견했다며 경찰에 신고했다.습득자인 이들이 돈의 소유권을 넘겨받을 수 있다는 의미이다.

다만 현금이 아파트 화단에서 발견된 만큼 이들에게만 소유권이 돌아가지는 않을 수도 있다.

유실물법에 따르면 관리자가 있는 건축물 등에서 타인의 물건을 습득했을 경우 민법에 따른 실제 습득자와 건축물 점유자가 소유권을 절반씩 나눠야 한다고 규정하고 있다.

이에 따라 경비원과 환경미화원은 점유자인 관리사무소 등과 소유권을 나눠 가지게 될 전망이다.

한편,웨스턴 유나이티드 fc유실물의 소유권을 취득하게 되면 소득세법상 기타소득에 해당돼 세금 22%를 제외하고 지급받는다.

앞서 지난 4일 오후 2시쯤 울산 한 아파트에서 경비원이 순찰 중 화단에 있던 검정 비닐봉지 안에서 현금 5천만원을 발견했다.

이어 6일에는 이 아파트 환경미화원이 화단에서 검정 비닐봉지 안에 든 현금 2천500만원을 발견해 경찰에 신고했다.

경비원과 미화원이 발견한 현금은 모두 5만원권으로 100장씩 다발로 묶여 있던 상태였다.

두 번째로 발견된 현금 2천500만원은 앞서 5천만원을 발견한 장소에서 1ｍ 정도 떨어진 곳에 있었던 것으로 알려졌다.
