14일 법조계에 따르면 서울북부지법 형사4단독(이창열 판사)은 사기,농구 월드컵 일본절도 등 혐의로 기소된 30대 여성 A씨에게 징역 10개월을 선고했다.다만 피해 회복 기회를 줄 필요가 있다며 법정구속은 하지 않았다.

A씨는 2017년 7월 10일 카드고객센터에 전화해 친언니 이름과 주민등록번호 등을 알려주며 신용카드를 발급받았다.2020년과 2022년에도 같은 수법으로 언니 명의 신용카드를 재발급받았다.

또 그는 이렇게 발급받은 언니 명의 신용카드로 2019년 3월부터 2022년 3월까지 6440만원을 인출하기도 했다.

재판부는 "피고인은 카드회사를 속여 신용카드를 발급받고 다시 갱신 발급받는 방법으로 약 5년간 범행해 죄책이 무겁다"며 "연체 원리금도 8000만원에 달하지만 피해가 회복되지 않았다"고 지적했다.

다만 "처음부터 악의적으로 카드대금을 편취하려고 명의를 도용한 것으로 보이지 않고 상당액이 카드대금 돌려막기를 위해 사용된 것으로 보인다.또 연체금 변제 명목으로 4000만원을 상환하기로 하는 등 피해 회복을 위해 노력했다"며 양형 이유를 밝혔다.
