(서울=연합뉴스) 김현수 기자 = 동구바이오제약이 식품의약품안전처의 의약품 제조·품질관리기준(GMP) 적합 판정 취소 처분에 불복해 법원에 집행 정지 가처분을 신청했다.

동구바이오제약은 식약처의 처분에 대해 집행정지 가처분 신청 및 행정처분 취소 소송을 제기했다고 14일 밝혔다.

식약처는 지난 13일 동구바이오제약이 GMP 적합 판정을 보유한 4개의 대단위 제형군 중 내용 고형제 제형에 GMP 적합 판정 취소 처분을 내렸다.

내용 고형제는 액체가 아닌 단단한 재질의 먹는 약을 말한다.

앞서,어른이 된 토토식약처는 지난 2월 동구바이오제약이 제조·판매하는 해열·진통·소염제 '록소리스정'과 당뇨병용제 '글리파엠정 2/500㎎' 등 내용 고형제 2개 품목에 대해 제조·판매를 잠정 중지하고 회수 조치한 바 있다.

당시 식약처는 동구바이오제약의 GMP 준수 여부 등을 점검한 결과,이들 2개 제품의 제조 과정에서 첨가제 등을 임의로 변경해 허가 사항과 다르게 제조하고,어른이 된 토토제조 기록서에는 허가 사항과 동일하게 제조한 것처럼 거짓 작성하는 등 약사법 위반 사항을 확인하며 이같이 조치했다고 설명했다.

동구바이오제약은 이번 가처분 신청이 행정처분 효력 발생일 이전에 인용될 경우,소송 결과가 최종 확정될 때까지 내용 고형제 의약품을 제조·판매할 수 있다.

식약처는 GMP 적합 판정을 받은 업체가 고의로 의약품을 불법 제조하고 기록서를 거짓으로 작성하는 행위를 근절하기 위해 2022년 12월부터 GMP 적합 판정 취소 제도를 시행 중이다.

지금까지 식약처로부터 GMP 취소 판정을 받은 기업은 한국휴텍스제약,어른이 된 토토한국신텍스제약,동구바이오제약 등이다.

다만,어른이 된 토토한국휴텍스제약·한국신텍스제약 역시 해당 처분에 대한 집행정지 가처분 신청을 제기해 법원이 이를 인용,실제 GMP 적합 판정이 취소된 사례는 없다.
