공안 조작 사건 '유럽간첩단' 사건 재심
1970년 징역 7년 선고…대법서 무죄 확정

[서울=뉴시스] 이종희 기자 = 1960년대 대표적인 공안 조작 사건인 일명 '유럽간첩단' 사건으로 억울하게 옥고를 치른 피해자에 대한 재심에서 무죄가 확정됐다.

10일 법조계에 따르면 대법원 2부(주심 김상환 대법관)는 지난달 13일 국가보안법 위반,16 월드컵반공법 위반 등의 혐의로 기소된 김신근씨에 대한 재심에서 무죄를 선고한 원심을 확정했다.

김씨는 1966년 이른바 '유럽간첩단' 사건에 연루돼 영국 유학 중 사회주의를 공부하거나 북한 공작원을 접선하고 지령서신을 전달하는 등 혐의를 받았다.

재판에 넘겨진 김씨는 1970년 대법원에서 징역 7년에 자격정지 7년이 확정됐다.재심에서 무죄가 확정되면서 54년 만에 누명을 벗게 됐다.

김씨 외에도 당시 박노수 교수와 김규남 의원은 사형을 선고받았다.함께 기소된 김판수씨는 징역 5년을 선고받았다.

이들에 대한 재심은 지난 2015년 대법원에서 무죄가 확정됐다.

김씨는 2022년 재심을 청구했다.서울고법은 진술이 임의성 없는 상태에서 이뤄졌고 위법수집증거에 해당한다고 판시해 무죄를 선고했다.

대법원은 원심 판단에 잘못이 없다고 보고 상고를 기각했다.

대법원은 "원심의 판단에 논리와 경험의 법칙을 위반해 자유심증주의의 한계를 벗어나거나 진술의 임의성,16 월드컵증거능력,16 월드컵국가보안법위반죄와 반공법위반죄의 성립 등에 관한 법리를 오해한 잘못이 없다"고 말했다.
